These Conditions shall govern the sale of the products listed at the online store by Sky Free Shop to the buyer (means the person or legal entity identified in the order as the purchaser of the products).

By ordering the products and/or accepting delivery of the products, the passenger agrees to be bound by and accepts these Conditions.

Buyer shall indicate the products it wishes to order and the quantity required, at the price specified by Sky Free Shop at the Online Store, by placing an order on the designated online form at the Online Store and providing to Sky Free Shop all necessary information as may be required by Sky Free Shop.

All orders made by the Buyer for one or more Product(s) shall be deemed to be an offer made by the buyer to purchase such product(s) upon the terms of these Conditions and for the selected products and quantities set out in the order. All orders shall be subject to acceptance by Sky Free Shop.

Sky Free Shop may accept an order by email within a reasonable time after buyer has made the order, to accept and confirm the price, quantity and product(s) ordered by the buyer.

Product availability and Prices

Prices are shown in US dollars and are valid only for the duration of the publishing on the Pre-Order website. Prices are subject to change without prior notification. Prices indicated at Special Offer are non-negotiable.

Images, features, specifications and prices are illustrative and may vary or change without prior notice.

All products offered are subject to availability and while supplies last.

The availability of products, brands and models may vary according to the current offer provided by Sky Free Shop.

Payment

We accept all major credit cards: VISA, MasterCard, American Express.

Sky Free Shop shall be entitled to accept or reject the buyer’s order in whole or in part without assigning any reason due to product unavailability, low inventory levels, or for any other reason.

All credit card payments are subject to the approval of the Credit Card Company and the relevant paying bank. Sky Free Shop shall not be liable in any way if the Credit Card Company or the paying bank refuses to process or accept any Credit Card or Credit Card particulars for any reason.

The buyer agrees to submit to Sky Free Shop and its payment service provider such Credit Card and other personal information as may be reasonably requested by Sky Free Shop or its payment service provider to process the order.

Risk in the products shall pass to the buyer upon delivery of the products to buyer.

Title in the products shall not pass to buyer until receipt by Sky Free Shop of full and final payment for the products and delivery of the products to buyer.

Order delivery and cancellation

Subject always to Sky Free Shop’s acceptance of the order, Sky Free Shop shall deliver the products to designated passenger at the store.

Sky Free Shop reserves the right from time to time, without liability or prior notice, to withdraw or cease to make available any or all products from the Online Store or to change its prices or specifications of any product.

If the order has already been processed, there is no further possibility of cancellation. In this case, ask for help from our team at the store.

Acceptance, Returns & Refunds

Unless the buyer notifies Sky Free Shop in writing to the contrary within 30 days of the purchase date, the products shall be deemed to have been accepted by the buyer as being in good condition and in accordance with the contract.

Sky Free Shop guarantees that every product is in good condition at the time of purchase. Sky Free Shop will not entertain any returns or requests for refunds.

Sky Free Shop makes no warranty in respect of any product, and Sky Free Shop’s Returns Policy is in lieu of all other warranties express or implied, including any implied warranties of merchantability, satisfactory quality, compliance with description and fitness for a particular purpose. Sky Free Shop’s sole liability for defective or non-compliant products is limited to the Returns Policy.

If the product has manufacturing defects after the stated period, the customer must go directly to the manufacturer or authorized distributor (see product warranty brochure), to make their warranty claim.

Sky Free Shop reserves the right to refuse any claims under the Returns Policy if:

1 - The claim does not meet any of the Conditions, or falls within any of the exclusions, under the Returns Policy; or

2 - The defect is the result of:

(i) improper use or mismanagement by buyer;

(ii) operation of the products other than in accordance with the operating manual or instructions;

(iii) use of the products in a manner not reasonably contemplated by Sky Free Shop;

(iv) modification of the products not authorized by Sky Free Shop

(v) subjection of the products to unusual or un recommended physical, environmental or electrical stress; or

(vi) buyer’s failure to comply with any terms of these Conditions.

IMPORTANT: it is required to present the original purchase receipt, as well as passenger’s official identification to make changes and/or returns.

Exclusion & limitation of liability

In no event shall Sky Free Shop be liable to the buyer or any third party for any indirect, special, consequential, exemplary or punitive loss or damage for any breach of these Conditions, including but not limited to loss of profits, loss of business or goodwill, loss of use, or any claim by any third party, even if Sky Free Shop has been advised of the possibility of such loss or damage.

The total liability of Sky Free Shop to the buyer for any and all claims whether by the buyer or by any other person and howsoever arising in connection with or arising out of the sale, supply, delivery possession, replacement or use of a product or resulting from the breach of the contract and/or these Conditions by Sky Free Shop shall not in any event exceed the price of the product giving rise to such claims.

Amendment

Sky Free Shop reserves the right to change these Conditions without prior written notice at any time, at Sky Free Shop sole discretion, by posting a copy of the amended Conditions at the Online Store.

Any attempt to modify, supplement or amend these Conditions by the buyer will be null and void, unless expressly agreed to in writing by Sky Free Shop.

Complete Contract

The contract and these Conditions represent the entire understanding between Sky Free Shop and the buyer concerning the sale and supply of the products, and shall form the exclusive statement of all the matters covered by the contract and these Conditions. Any and all previous course of dealings, written or oral understandings, discussions, representations, correspondence and communications between the parties relating to the matters covered by the contract and/or these Conditions are hereby superseded.

Any term or condition of the buyer’s order which is any way inconsistent with or in addition to these Conditions shall not be applicable or binding on Sky Free Shop, unless otherwise agreed in a written agreement signed by buyer and Sky Free Shop, and any failure by Sky Free Shop to object shall not be considered a waiver of these Conditions.

Assignment

The buyer shall not assign or otherwise transfer the contract or any of its rights and obligations hereunder, whether in whole or in part without the prior written consent of Sky Free Shop. Any such unauthorized assignment shall be deemed null and void.

No failure on the part of Sky Free Shop to exercise, and no delay on its part in exercising, any right or remedy under the contract will operate as a waiver thereof, nor will any single or partial exercise of any right or remedy preclude any other or further exercise thereof or the exercise of any other right or remedy.

Illegality

If any provision of these Conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of these Conditions and the remainder of the provisions in question shall not be affected thereby.

Rights of Third Parties

A person or entity who is not a party to the contract shall have no right under the contract to enforce any term of the contract, regardless of whether such person or entity has been identified by name, as a member of a class or as answering a particular description.
